Traveller Terms of Services

1. Acceptance of Terms

By accessing or using Kodama Travel (the "Platform"), you agree to comply with and be bound by these terms and conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Description of Service

Kodama Travel owns and operates a marketplace platform which enables travellers to search and book tours, and tour operators to sell tours/experiences/acivities. The tours are offered by third-party tour operators ("Operators"). Kodama Travel does not own, operate, or control any tours.

3. Booking and Payment

3a. Booking Confirmation: When you book a tour through the Platform, you agree to provide accurate and complete information. The booking is confirmed when payment is successfully processed.

3b. Payment: Prices are listed in your chosen currency and include any applicable taxes. Payment methods accepted will be specified on the Platform.

3c. Cancellation and Refunds: Operators have their own cancellation policies, which are listed on their individual listing page. Refund eligibility and amounts are subject to the specific terms of the Operator.

4. Operator Responsibility

4a. Quality of Tours: Operators are responsible for the quality and delivery of the tours. Kodama Travel reserves the right to delist Operators who are found to mis-lead travellers over the accuracy and/or reliability of their tour information.

4b. Insurance: It is the Operator's responsibility to carry appropriate insurance for the tours offered.

5. User Responsibilities

5a. Accuracy of Information: Users must provide accurate and truthful information when booking a tour. Kodama Travel is not responsible for any consequences resulting from inaccurate information.

5b. Code of Conduct: Users agree to behave responsibly and respectfully during tours. Kodama Travel reserves the right to suspend or terminate accounts for inappropriate behaviour.

6. Intellectual Property

All Kodama Travel generated content on the Platform, including text, images, and logos, is the property of Kodama Travel and is protected by intellectual property laws.

7. Liability and Disclaimers

Limitation of Liability: Kodama Travel is not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Platform or the tours.

8. Privacy

Privacy Policy: The Kodama Travel Privacy Policy outlines how user information is collected, used, and disclosed. By using the Platform, you agree to the terms of the Privacy Policy.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Kingdom, where Kodama Travel is registered. Any disputes arising from these Terms or the use of the Platform shall be resolved through arbitration in accordance with the rules of the United Kingdom.

10. Modification of Terms

Kodama Travel reserves the right to modify these Terms at any time. Users will be notified via email of any changes, and continued use of the Platform constitutes acceptance of the modified Terms

Supplier Terms of Services

1. Acceptance of Terms

By registering as a Supplier on Kodama Travel Your, you agree to comply with and be bound by these terms and conditions ("Terms"). If you do not agree to these Terms, please do not register on the platform.

2. Supplier Registration and Account

2a. Eligibility: To become a supplier, you must provide accurate and complete information during the registration process. You must be legally able to carry out the experience you are offering and enter into contracts with Kodama Travel.

2b. Account Security: You are responsible for maintaining the customer confidentiality when they book with you, and do not share customer details with 3-rd parties without their consent.

3. Listing and Booking

3a. Listing Information: Suppliers are responsible for providing accurate and up-to-date information about your travel services, including but not limited to, descriptions, pricing, availability, and cancellation policies.

3b. Booking Confirmation: Suppliers agree to fulfill confirmed bookings as described in your listings. The booking is confirmed when payment is successfully processed.

4. Payments and Fees

4a. Pricing: Suppliers are responsible for setting and updating your own prices. Prices should include any applicable taxes.

4b. Commission Fees: Kodama Travel charges a commission on each booking. Details regarding commission rates and payment schedules is provided in the payment guideline.

4c. Payment Processing: Kodama Travel will handle payment processing for bookings. Payments will be transferred to the supplier's designated account after deducting applicable fees.

5. Cancellation and Refunds

Cancellation Policies: Suppliers must clearly specify your cancellation policies, and these policies must be adhered to. Kodama Travel defaults to free cancellation within 24 hours of the trip start time.

6. Quality Assurance

Service Quality: Suppliers are responsible for providing high-quality services that meet or exceed the expectations set in your listings. Customer Reviews: Customers who have booked the trip may leave reviews and ratings. Suppliers are encouraged to address customer feedback and resolve any issues promptly. Suppliers have the right to flag false reviews

7. Compliance with Laws and Regulations

Suppliers must comply with all applicable laws and regulations, including those related to the provision of travel services, consumer protection, and data privacy.

8. Intellectual Property

Suppliers retain ownership of the content they upload to the platform but grant Kodama Travel a license to use, display, and promote the content on the platform. Suppliers should not use photos that they do not have the right to use.

9. Indemnification

Suppliers agree to indemnify and hold Kodama Travel and employees harmless from any claims, losses, or damages arising out of or in connection with the supplier's use of the platform. Kodama Travel reserves the right to terminate a supplier's account for violations of these Terms or for any other reason at its discretion.

10. Modification of Terms

Kodama Travel reserves the right to modify these Terms at any time. Suppliers will be notified of any changes, and continued use of the platform constitutes acceptance of the modified Terms.
